Witnesses for Marriage Registration in Delhi: Rules and Documents
Marriage registration in Delhi needs two witnesses under the Hindu Marriage Act and the Delhi 2014 Order, and three under the Special Marriage Act. Witnesses must be adults who know of the marriage, appear in person with the couple, and bring original identity and address proof. The 2014 Order and Delhi guidelines describe witnesses who can prove permanent residence in Delhi.

Witnesses are the people who stand beside you at the SDM office and confirm, by their presence and signatures, that your marriage is real. Getting them right is simple, but getting them wrong is one of the most common reasons registration appointments fail. This guide explains how many witnesses you need in Delhi, who qualifies, the Delhi address rule, what documents they bring, and how to avoid last-minute problems.
How many witnesses do you need?
| Registration route | Witnesses |
|---|---|
| Hindu Marriage Act (Section 8) | 2 |
| Delhi (Compulsory Registration of Marriage) Order, 2014 | 2 |
| Special Marriage Act, court marriage | 3 |
| Special Marriage Act, registering an existing marriage (Sections 15–16) | 3 |
Who can be a witness?
Witnesses should be:
- adults;
- people who know of the marriage, ideally who attended the wedding;
- able to prove their identity with original documents;
- able to prove their address, typically in Delhi.
They can be parents, siblings, cousins, uncles and aunts, friends, neighbours or colleagues. They do not need to share your religion, caste or community.
The Delhi address rule
The Delhi (Compulsory Registration of Marriage) Order, 2014 says the couple should appear with two witnesses who can certify the solemnisation of the marriage and prove permanent residence in Delhi. Delhi district guidelines for registration under the Hindu Marriage Act and the Special Marriage Act also describe witnesses with proof of permanent Delhi residence.
In practice, choose witnesses whose identity or address documents show a Delhi address. A witness with only an address in Gurugram, Noida or another state may not be accepted at a Delhi office.
What witnesses must bring
| Item | Notes |
|---|---|
| Original identity proof | Aadhaar, PAN, voter ID, passport or driving licence |
| Original address proof | Aadhaar, voter ID, passport, utility bill; ideally Delhi |
| Self-attested photocopies | Of both |
| Passport-size photographs | Two, in case the office asks |
Ask each witness to check that their name and address in your application match their documents.
What witnesses do at the appointment
- Arrive with you and wait together until your turn.
- Show their originals to the official.
- Answer simple questions if asked, such as how they know you or whether they attended the wedding.
- Sign the register in the presence of the marriage officer.
Under the Special Marriage Act, witnesses also sign the declaration and the Marriage Certificate Book. See witnesses for court marriage.
Choosing witnesses: practical advice
- Reliability first. Choose people who will turn up on time on a working day.
- Delhi address proof. Check their Aadhaar or voter ID before you put them in the application.
- People who attended. Witnesses who were at the wedding can answer questions naturally.
- Keep a reserve. A third person who can step in if needed.
- Brief them. Send them the date, time, address, list of documents and an idea of how long it will take.
A witness briefing message
Copy and send this to your witnesses:
Thank you for being our witness for our marriage registration. Please come to [SDM office address] on [date] at [time]. Bring your original Aadhaar (or voter ID/passport) and one more address proof showing your Delhi address, two self-attested photocopies of each, and two passport-size photographs. It may take two to three hours. You will sign the register in front of the marriage officer, and you may be asked how you know us. Thank you!
Common witness problems
| Problem | Prevention |
|---|---|
| Witness does not turn up | Confirm the evening before; keep a reserve |
| Witness brings only photocopies | Ask for a photo of their packed originals |
| Witness has no Delhi address proof | Check documents before naming them |
| Witness’s name spelt differently in the application | Copy names from their ID |
| Witness did not attend and cannot answer questions | Choose people who attended or know the couple well |
| Witness leaves before the couple’s turn | Brief them about waiting times |
Witnesses for couples without family support
Some couples marry without family approval. Friends and colleagues are entirely acceptable witnesses. If you are concerned about your safety, see police protection for couples marrying by choice.
Witnesses for NRI and out-of-town couples
Couples who married in Delhi but live elsewhere, and NRI couples on short visits, often find the witness rule the hardest part. Most of their wedding guests live outside Delhi, and the people with Delhi addresses may be relatives they barely know. A few approaches help:
- Ask Delhi-based relatives who attended the wedding well before the appointment, and collect copies of their documents early.
- Look among friends and colleagues in Delhi who know both of you; they need not have attended, but should know of the marriage.
- Register in your home state instead, if its rules allow, where witnesses are easier to find. See married in Delhi but living elsewhere.
Whatever you choose, do not fill the gap with people supplied by an agent.
What witnesses are taking on
Signing as a witness is a small but real responsibility. A witness confirms to the marriage officer that they know the couple and that the marriage took place. If the registration is later questioned, for example in a dispute or a visa inquiry, a witness may be asked about it. Explain this to your witnesses so they agree with full understanding. Most people are happy to help once they know what is involved.
Do not use paid or unknown witnesses
Some agents offer “witnesses” for a fee. This is risky: witnesses vouch for your marriage and may be asked how they know you. A witness who clearly does not know you can lead the officer to ask more questions or refuse the registration, and a marriage resting on false witness statements can cause legal trouble later, for example at a visa interview.
Worked example
Neha and Aditya registered under the Hindu Marriage Act in South Delhi. Their witnesses were Neha’s cousin from Lajpat Nagar and Aditya’s colleague from Saket, both with Aadhaar cards showing South Delhi addresses, and both had attended the wedding. They briefed both a week ahead and confirmed the night before. The appointment took less than an hour.
Worked example: a witness problem solved
Kiran and Rahul named Rahul’s brother from Noida as a witness. The office pointed out that his address was outside Delhi. Fortunately, they had brought Kiran’s friend from Mayur Vihar as a reserve, who had attended the wedding and carried her documents. The registration went ahead.

Frequently asked questions
Can parents be witnesses for marriage registration?
Yes. Parents, siblings and other relatives can be witnesses if they are adults with valid identity and address proof.
Must witnesses have attended the wedding?
It is best if they did. The 2014 Order describes witnesses who can certify the solemnisation of the marriage. At minimum, they should know of the marriage.
Can a witness live outside Delhi?
The 2014 Order and district guidelines describe witnesses with proof of permanent Delhi residence. Choose witnesses with Delhi address proof to avoid problems.
Can a witness be under 18?
No. Witnesses should be adults.
Do witnesses need to come to the Citizen Service Centre or upload documents?
Their details and copies of their documents go into the application; they appear in person at the SDM office on the appointment day.
What do witnesses sign?
They sign the marriage register (and, under the Special Marriage Act, the declaration and the Marriage Certificate Book) in front of the marriage officer.
Can we change a witness after applying?
Often yes, if the new witness meets the requirements, but their details may need updating. Ask the office.
Can a foreign national be a witness?
Possibly, if they have a passport and Delhi address proof, but confirm with the office first.
Can we use witnesses provided by an agent?
Avoid it. Witnesses vouch for the marriage and may be asked how they know you. Use people who genuinely know you.
What if a witness forgets their original ID?
The office may not accept them. Bring a reserve witness or reschedule.
