Witnesses for Court Marriage in Delhi: Who Qualifies and What They Bring

Quick answer

A court marriage under the Special Marriage Act needs three adult witnesses who appear in person before the marriage officer on the day of marriage, sign the declaration and the Marriage Certificate Book, and bring original identity and address proof. Delhi guidelines describe witnesses with proof of Delhi residence. Friends, relatives and colleagues can all be witnesses.

Three people standing beside you at the marriage officer’s desk make your court marriage legally complete. Witnesses are not a formality you can skip, substitute or arrange at the last minute without risk. This guide explains who can be a witness for a court marriage in Delhi, what they must bring and sign, and how to avoid the most common witness problems.

Why court marriage needs three witnesses

Section 11 of the Special Marriage Act requires both partners and three witnesses to sign a declaration, in the form set out in the Act, in the presence of the marriage officer before the marriage is solemnised. Section 12 then requires the words of acceptance to be spoken in the presence of the officer and the three witnesses. Section 13 requires the three witnesses to sign the certificate entered in the Marriage Certificate Book.

So witnesses do three things: they sign the declaration, they witness the marriage itself, and they sign the certificate.

Who can be a witness

The Act does not limit who can be a witness beyond what is implied by their role. In practice, Delhi offices expect witnesses to be:

  • adults;
  • of sound mind, able to understand what they are signing;
  • identifiable, with original identity proof;
  • able to show their address, and commonly a Delhi address, since Delhi’s guidelines for Special Marriage Act registration describe witnesses with proof of permanent Delhi residence;
  • known to the couple, so they can confirm identities if asked.

Friends, colleagues, neighbours, siblings, parents and other relatives can all be witnesses. Witnesses do not have to share your religion.

What witnesses must bring

ItemNotes
Original identity proofAadhaar, passport, voter ID, PAN card or driving licence
Original address proofAadhaar, passport, voter ID, driving licence or a utility bill; ideally a Delhi address
Self-attested photocopiesOf both documents
Passport-size photographsSome offices ask for these; carry two

Ask each witness to check that the name and address on their identity proof match what you have given in the application.

When witnesses are needed

Witnesses are needed on the day of marriage, after the 30-day notice period. They do not need to come when you give notice. If you are registering an existing marriage under Sections 15 and 16, the witnesses appear on the day of registration.

What happens to witnesses on the day

  1. They arrive with you and wait with you until your turn.
  2. Their original documents are checked against the details given.
  3. They sign the declaration in the presence of the marriage officer.
  4. They witness both of you saying the words of acceptance.
  5. They sign the certificate entered in the Marriage Certificate Book.

The marriage officer may ask them how they know you. A simple honest answer is enough.

Choosing your three witnesses: practical tips

  • Choose reliable people. A missing witness on the day means no marriage that day.
  • Choose people with Delhi address proof where possible.
  • Brief them in advance about the date, the time, the office address and the documents.
  • Keep a reserve. A fourth person who can step in if one witness falls ill is invaluable.
  • Avoid people who disapprove of the marriage; they may not turn up or may create difficulty.

Witnesses for couples facing family opposition

Some couples marrying by court marriage do not have family support. Friends and colleagues are perfectly acceptable witnesses. If you are worried about your safety or about someone interfering on the day, you can approach the police for protection in advance. See police protection for couples marrying by choice.

Can you hire witnesses?

Some agents offer “witnesses” for a fee. This is risky. A witness signs a legal declaration and may be asked whether they know you. A stranger paid to sign may not be able to answer honestly, and a marriage resting on witnesses who do not know the couple can attract questions later, for example in a visa interview or a dispute. Use people who genuinely know you.

If a witness cannot come

If a witness drops out:

  • Replace them with someone else who meets the requirements. Witnesses are not named in the notice, so you can change them.
  • If you cannot find three witnesses for the booked date, ask the office for a new date within the three-month window of the notice.
  • Do not attend with two witnesses hoping the office will make an exception.

Worked example

Rhea and Faizan book their court marriage at the North Delhi office. Their witnesses are Rhea’s sister, Faizan’s colleague and a family friend, all with Aadhaar cards showing Delhi addresses. The evening before, Faizan’s colleague falls ill. Because they had asked a neighbour to be on standby, they call her, she brings her Aadhaar and voter ID, and the marriage goes ahead as booked.

Witnesses from outside Delhi

Sometimes the people closest to you live in Gurugram, Noida or another city. Delhi’s guidelines for Special Marriage Act registration describe witnesses with proof of permanent Delhi residence, so a witness with only an out-of-state address may not be accepted at a Delhi office. If you want a particular out-of-town friend or relative involved, include them as one of four people attending, but make sure three of your witnesses have Delhi address proof. Ask the office in advance if you are unsure; practice can vary.

The witnesses’ declaration

The declaration the witnesses sign is not a casual signature. In the form set out in the Act, the partners declare that they meet the legal conditions for marriage, and the witnesses sign it in the presence of the marriage officer. Making a false declaration is an offence under the Act. Witnesses should therefore be people who know the couple and have no reason to believe any of the legal conditions is not met. This is another reason not to use strangers supplied by agents.

Witnesses and privacy

Witnesses’ names, addresses and signatures appear in the Marriage Certificate Book. If you or your witnesses are concerned about privacy, for example because of family opposition, discuss it with them beforehand so they understand what they are signing and where their details will be recorded.

Witness questions that come up on the day

Marriage officers sometimes ask witnesses short questions to confirm they are genuine. Typical questions include how long they have known the couple, how they know them (friend, colleague, relative), and whether they understand that they are witnessing a marriage. Witnesses do not need to prepare answers; they should simply answer truthfully. A witness who clearly does not know the couple, or who seems to have been brought in at the last minute, can lead the officer to ask more questions or to postpone.

A witness checklist to send your witnesses

Copy this and send it to each witness a few days before the marriage:

  • Date and time to arrive, and the SDM office address with a map link.
  • Bring your original Aadhaar (or passport or voter ID) and one more address proof if possible.
  • Bring two self-attested photocopies of each, and two passport-size photographs.
  • Plan for two to three hours; carry water.
  • You will sign a declaration and the Marriage Certificate Book in front of the marriage officer.
  • You may be asked how you know the couple; answer simply and truthfully.

Get your witness plan right

Witness problems are the most common reason a court marriage is postponed on the day. WedProof confirms each witness’s documents in advance and helps you plan a reserve. Use the form on this page for a free check.

Frequently asked questions

Can our parents be witnesses?

Yes. Parents, siblings and other relatives can be witnesses if they are adults with valid identity and address proof.

Do witnesses need to know us well?

They should know you and be able to confirm your identities if asked. They sign a declaration in the presence of the marriage officer.

Can a foreign national be a witness?

Delhi practice expects identity and address proof and, commonly, Delhi residence. A foreign national living in Delhi with a passport and proof of Delhi address may be accepted, but confirm with the office.

What if a witness doesn't turn up?

The marriage cannot be solemnised without three witnesses present. Bring a reserve witness if you can, or reschedule within the three-month notice window.

Can the same person be a witness for both partners?

Witnesses are witnesses to the marriage, not to one partner. Each of the three witnesses signs once; you need three different people.

Do witnesses need to come for the notice?

No. Witnesses are needed on the day of marriage, when they sign the declaration and the Marriage Certificate Book.
