Marriage Registration When You Live in a Rented House in Delhi
Tenants can register a marriage in Delhi using a registered rent agreement as address proof, ideally supported by a utility bill or bank statement at the same address. A registered agreement is commonly accepted; an unregistered one may be questioned. For court marriage, the rent agreement also helps prove the 30 days' residence in the district that the Special Marriage Act requires.
- Best tenant proof
- Registered rent agreement
- Supporting proof
- Utility bill, bank statement, updated Aadhaar at the same address
- Landlord's bills
- Use together with the rent agreement
- Court marriage
- Agreement start date helps prove 30 days' residence
- Alternative
- Use the other spouse's address proof or the place of marriage
A large share of Delhi’s young couples rent their homes: a flat in Laxmi Nagar, a floor in Lajpat Nagar, a room in a PG near the office. Their Aadhaar cards often still show their parents’ addresses, and their electricity bills are in the landlord’s name. When they register their marriage, the question is: what counts as address proof for us? This guide explains how tenants can register a marriage in Delhi, what to use as address proof, and how to make sure the right office has jurisdiction.
Why address proof matters for tenants
In Delhi, you apply to the SDM office of the district where either spouse lives, or where the marriage took place. Your address proof tells the office which district that is. For tenants, the challenge is showing that you actually live at the rented address. See address proof for marriage registration.
The best tenant proof: a registered rent agreement
Delhi district guidelines list a registered rent agreement among accepted residence proofs. A registered agreement:
- is recorded with the sub-registrar;
- names you as a tenant at a specific address;
- shows a start date, which also helps prove how long you have lived there.
If you have one, use it as your main address proof.
Strengthening the agreement with supporting documents
Pair the rent agreement with at least one more document at the same address:
| Supporting document | Notes |
|---|---|
| Utility bill in your name | Strongest support |
| Utility bill in the landlord’s name | Acceptable when paired with the agreement |
| Bank statement or passbook at the address | Shows you receive post there |
| Updated Aadhaar at the address | Strong, if you have updated it |
| Gas connection document | Shows residence |
| Employer letter confirming address | Supporting only |
If your agreement is not registered
Many tenants in Delhi have notarised agreements on stamp paper that are not registered. These may be questioned. Options:
- Register the agreement with the sub-registrar, which takes a few days.
- Add strong supporting documents, such as a bank statement and an updated Aadhaar.
- Use the other spouse’s address proof if they have clearer documents in a Delhi district.
- Apply on the basis of where the marriage took place, if it was in Delhi.
Living in a PG or hostel
Paying-guest accommodation and hostels are common for young professionals and students. Useful proofs include:
- a rent receipt or agreement from the PG;
- a letter from the PG owner or hostel confirming your stay and dates;
- a bank statement showing the PG address.
Requirements vary between offices, so check before applying, especially if this is your only Delhi address.
Tenants and the Special Marriage Act
For a court marriage, at least one partner must have lived in the district for 30 days immediately before the notice. The start date on a registered rent agreement is useful evidence of this. If you moved into your rented home less than 30 days ago, either:
- give notice in your previous district, if you lived there for 30 days immediately before moving and can prove it; or
- wait until 30 days have passed at the new address.
See the 30-day residence rule.
When only one spouse rents in Delhi
Only one spouse needs Delhi address proof in the district for jurisdiction. If the groom rents in Delhi and the bride’s documents show her parents’ address in another state, the groom’s rent agreement can establish jurisdiction.
Registering your rent agreement
If your agreement is not registered and you want to strengthen it, you can register it through the Delhi sub-registrar process. In outline, the landlord and tenant execute the agreement on the prescribed stamp duty, and the document is registered at the sub-registrar’s office, increasingly with online appointment booking. Registration fees and stamp duty depend on the rent and term. It usually takes a few days. If your registration is not urgent, registering the agreement can be worth it, because the registered agreement will also help with bank accounts, Aadhaar updates and future applications.
Updating Aadhaar to your rented address
Updating your Aadhaar to the rented address, using the rent agreement and supporting documents as proof, makes future paperwork simpler. It is not required before marriage registration, but if you have the time, an updated Aadhaar is one of the strongest address proofs you can carry. Remember that the update date alone does not prove how long you have lived there, which matters for the Special Marriage Act’s 30-day rule.
If your landlord will not cooperate
Some landlords are reluctant to provide bills or sign letters. You can still rely on your own documents at the address: the rent agreement itself, a bank statement, a gas connection in your name or an updated Aadhaar. If none of these is available, use the other spouse’s address proof or the place of marriage for jurisdiction instead.
Common tenant mistakes
- Using Aadhaar with a parents’ address in another district or state, then choosing the district of the rented home.
- Relying only on an unregistered agreement with nothing else.
- Using bills in the landlord’s name without the agreement.
- Choosing the district of the office or a relative instead of the home.
- Giving notice for court marriage before completing 30 days at a new rented home.
Worked example: registered agreement
Ankit and Divya rent a flat in Mayur Vihar (East Delhi). Both Aadhaar cards show their parents’ addresses in other states. They have a registered rent agreement in Ankit’s name and electricity bills in the landlord’s name. They apply to the East Delhi office, using the registered agreement as Ankit’s address proof and the bills as support. Jurisdiction is clear.
Worked example: unregistered agreement
Rohan’s rent agreement for his flat in Saket is notarised but not registered. His Aadhaar still shows his parents’ address in Rohini. Rather than risk a question, he and Meera apply to the North West Delhi office covering Rohini, using his Aadhaar address, which is still valid. Alternatively, they could have registered the Saket agreement first.

Frequently asked questions
Is a rent agreement accepted as address proof for marriage registration?
Yes. A registered rent agreement is listed among accepted address proofs in Delhi.
My rent agreement is notarised but not registered. Will it work?
It may be questioned. Support it with a utility bill, bank statement or updated Aadhaar at the same address, or register the agreement.
The electricity bill is in my landlord's name. Can I use it?
Use it together with your rent agreement, which links you to the address.
Do both spouses need to be on the rent agreement?
No. One spouse's address proof in the district is usually enough for jurisdiction.
I live in a PG. What can I use?
A rent receipt or agreement from the PG, a letter from the PG owner, and a bank statement at that address can support residence. Confirm with the office.
How long must I have lived in the rented house?
For registration under the Hindu Marriage Act or the 2014 Order, there is no fixed minimum. For court marriage, one partner must have lived in the district for 30 days before notice.
Can the landlord be a witness?
Yes, if they meet witness requirements and know of your marriage.
Does the rent agreement need to show the spouse's name?
Not necessarily. It needs to show the name of the spouse whose address you are using.
What if the rent agreement expired?
Use a current agreement or other proof showing you still live there.
We live with my in-laws in their own house. What address proof do I use?
Use your spouse's address proof at that house, such as Aadhaar or a utility bill, for jurisdiction. Your own proof can show your earlier address.
Can I use my office address?
No. Address proof must show where you live.
