Attestation vs Apostille for a Marriage Certificate

Quick answer

An apostille is a single MEA certificate accepted by all Hague Apostille Convention countries, such as the UK, US, Canada and Australia. Attestation is a longer chain used for countries outside the Convention: state authentication, MEA attestation, the destination country's embassy in India, and often that country's foreign ministry on arrival. Check which your destination needs before you start.

Apostille
One MEA certificate; accepted by Hague Convention countries
Attestation
Chain: state, MEA, foreign embassy, often foreign ministry
MEA fee
₹50 per document for apostille; MEA normal attestation is free
Agency fee
₹90 per document + ₹3 per page
Rule of thumb
Check the destination first; never do both by default

“Apostille” and “attestation” are often used as if they meant the same thing. They do not, and doing the wrong one is one of the most common ways couples lose a week before a visa appointment. This guide explains the difference, which countries need which, and how each process works for an Indian marriage certificate.

How apostille works

The Hague Apostille Convention lets member countries recognise each other’s public documents through a single certificate. India joined in 2005. For a marriage certificate:

  1. Authenticate at the state level (unless covered by e-Sanad).
  2. Deposit with MEA’s authorised outsourced agency.
  3. MEA affixes the apostille.
  4. Collect and use it in any Convention country.

See how to get a Delhi marriage certificate apostilled.

How attestation works

Attestation is a chain of verifications, each confirming the previous one:

  1. State authentication of the certificate.
  2. MEA attestation, through the outsourced agency.
  3. Embassy attestation by the destination country’s embassy or consulate in India.
  4. Foreign ministry attestation in the destination country, often required on arrival.

The certificate is then accepted by authorities in that country only.

Which countries need which?

Apostille countries include, among many others, the United Kingdom, the United States, Canada, Australia, New Zealand, Germany, France, Italy, Spain, the Netherlands and Ireland.

Attestation is typically needed for countries outside the Convention. For Indian marriage certificates, the Gulf countries are the most common example, with the UAE requiring an embassy attestation chain. See marriage certificate for a UAE family visa.

Convention membership changes over time. Always check the current list and the receiving authority’s instructions.

Why couples do the wrong one

  • Following a friend’s advice for a different country.
  • Assuming “attestation” means apostille, because agencies use the terms loosely.
  • Moving countries, such as from the UAE to Canada, and reusing the old process.
  • Agents defaulting to apostille for every destination.

How to decide in three questions

  1. Where will the certificate be used? The receiving country, not the country you live in now, decides.
  2. Is that country a Hague Convention member? If yes, apostille. If no, attestation.
  3. What does the receiving authority say? Visa guidance or the receiving office’s checklist overrides general rules.

Translations in either process

Some destinations want a certified translation. Whether the translation itself needs apostille or attestation depends on the country. Ask before translating, so you translate once and authenticate once.

Step-by-step: the attestation chain in detail

1. State authentication

The certificate is first authenticated by the designated authority for Delhi documents. This confirms the signature of the issuing officer.

2. MEA attestation

Through MEA’s authorised outsourced agency, MEA attests the document on the basis of the state authority’s signature. Normal attestation is free at MEA, though the agency charges its service and scanning fees.

3. Embassy attestation

The destination country’s embassy or consulate in India attests the document. Each embassy sets its own fees, appointment rules and processing times, and some accept submissions only through designated agencies.

4. Foreign ministry attestation abroad

Many countries outside the Convention also require their own foreign ministry to attest the document after arrival. This is often the step people forget, and it can delay a residence visa.

MEAA few working daysA few working days

Documents you may need alongside

Whichever process you follow, keep these ready:

  • the original marriage certificate and photocopies;
  • passport copies of both spouses;
  • any translations required;
  • for attestation, the embassy’s application form and fee.

Where agencies help, and where to be careful

Agencies can save repeated visits, especially for the embassy step. But only MEA’s authorised outsourced service provider can deposit documents with MEA, so check that any agency you use either is that provider or works through it. Ask for receipts at each stage and for the apostille or attestation numbers, so you can verify them.

Worked example: Canada

Pooja’s husband is sponsoring her for Canadian permanent residence. Canada joined the Apostille Convention in 2024, so she gets her Delhi marriage certificate apostilled rather than going through the Canadian embassy. She checks the current IRCC document guidance before submitting.

Worked example: Dubai

Sanjay works in Dubai and wants to sponsor his wife’s family visa. He gets the certificate authenticated at the state level, attested by MEA, then attested by the UAE embassy in New Delhi, and finally by the UAE’s foreign ministry after arrival.

Common misunderstandings

“An attested photocopy is the same as attestation.” No. A photocopy attested by a gazetted officer or notary is a domestic convenience. International attestation is the state, MEA and embassy chain described above.

“Apostille is only for education documents.” No. Personal documents such as birth, death and marriage certificates, affidavits and powers of attorney are all apostilled by MEA.

“Once apostilled, I can use it anywhere.” Only in Convention countries. Elsewhere, you need attestation.

“The embassy will tell me at the interview.” Too late. Check the requirement while planning, because both processes take time.

Key terms explained

  • Hague Apostille Convention: the treaty that lets member countries accept each other’s documents with a single apostille.
  • Apostille: the MEA certificate recognised by Convention members.
  • Attestation chain: the series of verifications required for non-member countries.
  • Embassy attestation: verification by the destination country’s mission in India.

One-line takeaway

Apostille for Hague Convention countries, attestation for the rest; decide by the destination and the receiving authority’s instructions.

Frequently asked questions

What is the difference between attestation and apostille?

An apostille is one certificate from MEA accepted by Hague Convention countries. Attestation is a multi-step chain ending with the destination country's embassy, used for countries outside the Convention.

Which countries need an apostille?

Members of the Hague Apostille Convention, including the UK, US, Canada, Australia and most European countries. Check the current list.

Which countries need attestation?

Countries outside the Convention. For Indian marriage certificates, Gulf countries such as the UAE commonly require embassy attestation.

Is attestation more expensive?

MEA's normal attestation is free, but embassy fees and the foreign ministry step can make the total higher, and it takes longer.

Can I use an apostilled certificate in the UAE?

The UAE has generally required embassy attestation for Indian documents. Check the current position before applying.

Do I need both?

Usually not. Choose based on where the certificate will be used.

Who does state authentication in Delhi?

The designated authority for Delhi documents. Confirm the current authentication centre before starting.

Can agencies do the whole chain?

Yes, many agencies handle it, but only MEA's authorised outsourced provider can deposit with MEA. Check credentials and keep receipts.

Does an apostille work in a non-Convention country?

Generally no. A non-member country usually wants its own embassy's attestation, not an apostille.

If I move from the UAE to the UK, can I reuse the attested certificate?

No. For the UK, you would need an apostille on the certificate. The UAE attestation does not serve that purpose.

Can I verify an apostille?

Apostilles carry a unique number. Receiving authorities and, in many cases, applicants can verify them through official channels.

Which comes first, translation or apostille?

It depends on the destination. Some want the original apostilled and translated abroad; others want the translation done in India and apostilled. Ask first.

Is attestation needed for Indian use?

No. Inside India, the marriage certificate is used as issued. Apostille and attestation are only for use abroad.

How do I find out whether a country is a Convention member?

Check the Hague Conference on Private International Law's status table for the Apostille Convention, or MEA's list of member countries, and confirm with the receiving authority.
