Registering Your Marriage When One Spouse Is Abroad
Delhi registration normally needs both spouses to appear before the SDM. If one is abroad, the practical options are to register during a short visit using Tatkal, to ask the office about video appearance (the Delhi High Court has accepted virtual presence under the 2014 Order in some cases), or to explore registration abroad through the Indian mission where the law allows. A power of attorney cannot replace a spouse.
- Default rule
- Both spouses appear before the SDM
- Best practical option
- Short visit plus Tatkal (about one day, +₹10,000)
- Video appearance
- Accepted by the Delhi High Court in some cases; ask in advance
- Power of attorney
- Cannot replace a spouse's appearance
- Prepare in advance
- Documents, affidavits and witnesses ready before the visit
It happens all the time: the wedding took place in Delhi, then one of you flew back to work in Dubai, Toronto or London before the marriage was registered. Now a visa, a residence permit or a sponsorship application needs the certificate, and the spouse abroad cannot easily come back. This guide sets out the realistic options in Delhi, what each involves and what will not work.
The default rule: both spouses appear
Under the Delhi (Compulsory Registration of Marriage) Order, 2014 and the Hindu Marriage Act process, the couple applies jointly and both spouses appear before the SDM, with witnesses. The officer verifies identities and the details of the marriage in person. That is why registration usually cannot be completed by one spouse alone.
Option 1: A short visit with Tatkal
For most couples, the most reliable solution is a short, well-planned visit by the spouse abroad, combined with Tatkal registration:
- The spouse in India prepares everything in advance: documents for both, affidavits, witnesses, the e-District application.
- The spouse abroad books a short trip.
- Apply for Tatkal so that the appointment falls within the visit (Tatkal costs an extra ₹10,000 and typically gives an appointment on the next working day or very soon after).
- Both attend with two witnesses.
- Start apostille before the spouse leaves, or have family collect it.
With documents ready, a visit of three to five days can be enough. See Tatkal marriage registration in Delhi.
Option 2: Video appearance
In September 2021, the Delhi High Court (Justice Rekha Palli) held, in the case of an NRI couple in the United States who could not travel because of COVID-19 restrictions, that “personal presence” under the 2014 Order does not necessarily mean physical presence, and that the parties’ virtual presence could be enough for registration.
What that means for you:
- Ask the SDM office in advance whether it will allow video appearance in your case.
- Be ready to explain why physical presence is not possible, with evidence, such as visa restrictions, work commitments or medical reasons.
- Expect identity verification on the video call, and possibly an affidavit executed abroad.
- If the office declines, a court petition is possible but takes time and costs money; for most couples, a short visit is quicker.

Option 3: Affidavit executed abroad
Even when the spouse abroad must appear (in person or by video), their affidavit can sometimes be executed abroad, before an Indian embassy or consulate, or before a local notary with the legalisation the office requires. This saves time during the visit. Ask the SDM office in advance which forms of foreign-executed affidavit it accepts.
Option 4: Registration abroad
Indian missions abroad can solemnise and register certain marriages under the Foreign Marriage Act, 1969, where at least one party is an Indian citizen. However, a marriage that already took place in Delhi is normally registered in Delhi, not abroad. See the Foreign Marriage Act explained.
What will not work
| Idea | Why it fails |
|---|---|
| Power of attorney for the absent spouse | Registration needs each spouse’s own declaration and appearance |
| Someone impersonating the absent spouse | Illegal, and can void the registration and lead to prosecution |
| An agent “managing” the absence | No lawful shortcut exists |
| Registering only the spouse in India | Registration is joint |

Court marriage with one partner abroad
If you have not yet married and plan a court marriage under the Special Marriage Act, the partner in India (who has lived in the district for 30 days) can give notice in advance, so that the 30-day notice period runs before the partner abroad arrives. Both must be present for the solemnisation, with three witnesses. The marriage must take place within three months of the notice. See court marriage for NRIs.
Preparing for a short visit: checklist
- Documents for both spouses checked; names match passports
- Affidavits drafted (and, if possible, the absent spouse’s executed abroad)
- Two Delhi-resident witnesses confirmed for the likely appointment date
- Proof of the wedding ready: priest’s certificate, photos, card
- e-District application filed, ready for Tatkal
- Apostille plan if the certificate is needed abroad
Timeline for a short visit
| Day | What happens |
|---|---|
| Before the trip | Spouse in India prepares documents, affidavits and witnesses; files on e-District |
| Day 1 (arrival) | Check originals; confirm witnesses |
| Day 2 | Tatkal appointment with both spouses and two witnesses |
| Day 2–3 | Certificate approved and downloaded; checked against passports |
| Day 3–4 | State authentication started; apostille or attestation deposit arranged |
| Departure | Family member authorised to collect and courier the authenticated certificate |
Worked example: Dubai, four-day visit
Faisal works in Dubai and married Nazia in Delhi last year. Her UAE family visa needs an attested marriage certificate. Nazia prepares the file in Delhi. Faisal flies in for four days. They apply under Tatkal, attend the next-day appointment with two witnesses and start the attestation chain before he leaves.
Worked example: video appearance request
Manish is in the US on a visa that makes travel risky, and needs the certificate for his wife’s dependent visa. His wife asks the SDM office about video appearance, providing his visa documents and an affidavit executed before the Indian consulate. The office agrees to virtual appearance at the appointment.
Choosing between the options
If the spouse abroad can travel at all, a short visit with Tatkal is usually the fastest and most certain route: you control the dates, and the outcome does not depend on an office agreeing to an exception. Video appearance makes most sense when travel is genuinely impossible or very risky, for example because of visa restrictions, a medical condition or a family emergency, and you have evidence of that. Whatever you choose, prepare the paperwork completely before the spouse abroad is involved, so their time, in person or on screen, is spent only on the appearance itself.
Key terms explained
- Personal presence: the requirement that both spouses appear, which the Delhi High Court has said can include virtual presence.
- Tatkal: urgent registration under the Delhi 2014 Order.
- Foreign Marriage Act, 1969: the law under which Indian missions solemnise and register certain marriages abroad.
- Legalisation: authentication of a document executed abroad so it is accepted in India.
One-line takeaway
If one spouse is abroad, plan a short visit with Tatkal, or ask about video appearance; a power of attorney cannot stand in for a spouse.

Frequently asked questions
Can I register my marriage in Delhi if my spouse is abroad?
Normally both spouses must appear. Options include registering during a short visit with Tatkal, or asking about video appearance, which the Delhi High Court has accepted in some cases.
Can my spouse give me a power of attorney to register?
No. Registration relies on each spouse's own declaration and appearance, so a power of attorney cannot replace the absent spouse.
Can the absent spouse sign the affidavit abroad?
An affidavit can be executed abroad before an Indian mission or a notary, with legalisation as required. Check with the SDM office whether it will be accepted.
Is video registration available in every case?
No. It depends on the office and the circumstances. Ask in advance and be ready to explain why physical presence is not possible.
How short can the visit be?
With Tatkal and fully prepared documents, a visit of a few days can be enough.
Can we register at the Indian embassy abroad?
Indian missions can solemnise and register certain marriages under the Foreign Marriage Act, 1969, but registering a marriage that took place in Delhi is normally done in Delhi.
What if the visa needs a certificate before the spouse can travel?
Plan a short visit by the spouse who is abroad, or ask about video appearance, explaining the visa situation.
Can we do a court marriage with one partner abroad?
The partner abroad must be present for the solemnisation, but the resident partner can give notice in advance so that the 30-day period runs before the visit.
Can the spouse abroad appear at a later date?
Registration is joint, so the application is completed when both have appeared. Ask the office whether it can schedule the appointment around the visit.
Does the spouse abroad need Indian address proof?
Not necessarily. Jurisdiction can come from the place of marriage or the resident spouse's address. The spouse abroad needs identity and age proof.
