Using an Indian Marriage Certificate for a US Spouse Visa

Quick answer

For a US spouse petition (Form I-130) and the immigrant visa interview, you need a marriage certificate issued by the appropriate civil authority. In Delhi, that is the certificate issued under the Hindu Marriage Act, Special Marriage Act or the 2014 Order, not a religious certificate alone. Match names to passports, translate anything not in English, and check current USCIS and State Department guidance on authentication.

Required
Civil marriage certificate from the registering authority
Not enough alone
Temple, Arya Samaj or gurdwara certificate
Translation
Certified English translation for non-English documents
Names
Must match passports and petition forms
Also needed
Evidence of a bona fide marriage
Two people holding up their passports, ready to travel

For couples where one spouse is a US citizen or green card holder, the Indian marriage certificate is one of the first documents in the immigration file. US authorities are specific about what counts: they want the certificate issued by the civil authority that registered the marriage. Many Indian couples have only a religious certificate, or a certificate with spelling differences, and that leads to requests for evidence, delays at the National Visa Center or awkward questions at the interview. This guide explains how to get it right.

This is general information, not US immigration advice. Check current USCIS and State Department guidance, or speak to a US immigration attorney.

Which document counts

DocumentUse in a US spouse case
Certificate from the SDM under the Hindu Marriage Act, Special Marriage Act or 2014 OrderThe civil marriage certificate
Temple, Arya Samaj or gurdwara certificateRecords the ceremony; not a substitute for civil registration
Affidavit of marriageGenerally not accepted as a substitute
Wedding photos, card and guest listEvidence the marriage is genuine

If you have only a religious certificate, register the marriage in Delhi before filing. See how to register your marriage in Delhi.

Where the certificate is used

  1. The petition (Form I-130) filed by the US citizen or permanent resident spouse.
  2. The National Visa Center stage for consular processing, where civil documents are uploaded.
  3. The immigrant visa interview at the US embassy or consulate, where originals may be checked.
  4. Adjustment of status if the spouse is already in the US.

Make it consistent

US cases fail on inconsistencies more than on anything else. Before filing, compare the certificate with:

  • both passports;
  • birth certificates;
  • the forms you are filing;
  • any previous US visa applications.

Spellings, dates of birth, the date and place of marriage and parents’ names should be identical. If not, correct the certificate or prepare documents that explain the variation.

Previous marriages

If either spouse was previously married, US forms ask for details of how each previous marriage ended. Keep the divorce decree or death certificate ready, with translations if needed. The Delhi registration will also have required these. See documents for divorced applicants.

Translations

Any foreign-language document must be accompanied by a full English translation and a translator’s certification that it is complete and accurate and that the translator is competent to translate. Delhi certificates are often in English or bilingual, but check every part, including stamps and annotations.

Apostille

USCIS does not generally require apostilles on foreign civil documents. Apostille can still be useful for other US uses, such as state-level records or employer requirements. See apostille of a marriage certificate.

Bona fide marriage evidence

The certificate shows a legal marriage. US officers also assess whether the marriage is genuine. Typical supporting evidence includes wedding photos with family, evidence of shared life (joint accounts, leases, insurance), communication history and travel records. Couples who married long ago and registered recently should be ready to explain the timeline.

Getting the Delhi certificate: a quick route map for US applicants

  1. Choose the route. For a Hindu, Sikh, Jain or Buddhist wedding, register under the Hindu Marriage Act; for any wedding held in Delhi, the 2014 Order is available; for an inter-faith or civil marriage, use the Special Marriage Act (allow at least 30 days after notice).
  2. Check documents for both spouses: identity, date of birth and address proof, with names exactly as in the passports you will use for the US application.
  3. Collect proof of the ceremony: the priest’s, gurdwara or temple certificate, photos showing both of you, and the card. Keep extra copies; they double as relationship evidence.
  4. Prepare affidavits on e-stamp paper, notarised. If the spouse abroad cannot sign in Delhi, ask the office about an affidavit executed before an Indian mission.
  5. Apply on e-District and book a normal slot or Tatkal. Both spouses normally attend with two witnesses.
  6. Download and check the certificate the day it is approved.
  7. Authenticate if needed: state authentication and MEA apostille, which takes one to two weeks.
  8. Translate any non-English parts of the certificate or supporting documents.

For consular processing, keep the original certificate safe; consular officers may ask to see it at the interview. If you register late, keep a copy of the e-District application and fee receipts, which show when and how registration was done.

Document checklist for the US file

  • Delhi government marriage certificate, checked against passports
  • Religious ceremony certificate, if any
  • Certified translations of anything not in English
  • Apostilled copy, if requested or useful later
  • Previous marriage documents (divorce decree or death certificate), if relevant
  • Wedding photos, card and evidence of the relationship over time

Common mistakes

  1. Filing with only a religious certificate.
  2. Spelling or date differences between the certificate and passports.
  3. Forgetting to translate stamps or annotations.
  4. A recent registration with no explanation of an older wedding date.
  5. Previous marriage documents missing.

Worked example: religious certificate only

Vikram, a US citizen, married Divya at a temple in South Delhi and had only the temple certificate. Before filing the I-130, they registered the marriage under the Hindu Marriage Act in South Delhi and used the SDM certificate.

Worked example: married in 2015, registered in 2026

Rajesh and Sunita married in Delhi in 2015 and only registered in 2026, when Rajesh became a green card holder. They included the late-registered certificate, a short statement explaining that registration was not needed earlier, and photos, joint documents and their children’s birth certificates.

Worked example: name order differences

Neha’s passport shows “Neha Sharma”, but her Class 10 certificate lists “Sharma Neha”. Before registering, she makes sure the e-District application uses the passport order, so the certificate matches her passport and the I-130 forms exactly.

Keep a master copy of your details

Write down, once, the exact spellings, dates of birth, marriage date and place, and parents’ names as they appear in both passports. Use that master copy for the Delhi application, the affidavits and every US form. It is the simplest way to keep a long immigration file consistent.

Key terms explained

  • I-130: the US petition a citizen or permanent resident files for a relative, including a spouse.
  • Civil authority: the government office that registers marriages; in Delhi, the SDM.
  • National Visa Center: the US body that collects documents for immigrant visa cases.
  • Bona fide marriage: a genuine marriage, not one entered into only for immigration.

One-line takeaway

US cases need the civil certificate from the SDM, consistent with every other document; register first, then file.

Frequently asked questions

Which Indian marriage certificate does USCIS accept?

A marriage certificate issued by the civil registering authority. In Delhi, that is the certificate under the Hindu Marriage Act, Special Marriage Act or the 2014 Order.

Is an Arya Samaj certificate accepted for a US green card?

A religious certificate alone is generally not treated as a civil marriage certificate. Register the marriage with the SDM and use the government certificate.

Do I need an apostille for USCIS?

USCIS does not generally require an apostille on a foreign marriage certificate, but requirements can change. Check current guidance.

Does the certificate need translation?

Any document in a foreign language must be accompanied by a full English translation certified by the translator as complete and accurate.

We married years ago but registered recently. Is that a problem?

Late registration is lawful. Expect officers to look closely at evidence that the marriage is genuine and took place on the stated date.

Should the certificate show both parents' names?

Follow what the certificate shows. Make sure the information that is shown matches your other documents.

Can I file the I-130 before registering?

You need evidence of a legal marriage with the petition. Register first to avoid delays or requests for evidence.

What if names are spelt differently?

Correct the certificate or provide documents linking the names, and use consistent spellings across all forms.

Does a court marriage certificate work for US immigration?

Yes. A Special Marriage Act certificate is a civil marriage certificate.

Can a Tatkal certificate be used for a US case?

Yes. Tatkal changes the speed of registration, not the certificate.
