From Live-In Relationship to Registered Marriage

Quick answer

Live-in relationships between adults are not illegal in India, and courts have extended some protections to them, but they do not give the full rights of marriage. To marry, live-in couples follow the usual routes: a religious ceremony and registration, or the Special Marriage Act. There is no way to 'convert' a live-in relationship into a marriage without a ceremony or civil solemnisation. Delhi has no live-in registration requirement.

Live-in legal?
Yes, between consenting adults
Same as marriage?
No; rights are limited and depend on facts
To marry
Religious ceremony + registration, or Special Marriage Act
Conversion of status
No automatic conversion; you must marry
Delhi
No live-in registration law (unlike Uttarakhand's UCC)

Many couples in Delhi live together for months or years before marrying, or decide to marry when they plan children, buy a home or move abroad. Some assume that after years together they are already “as good as married”. In law, they are not. This guide explains the legal position of live-in couples, why marriage and registration matter, and how to make the move.

  • Not illegal. The Supreme Court has held that adults living together by choice commit no offence (for example, in S. Khushboo v Kanniammal, 2010).
  • Some protection. The Protection of Women from Domestic Violence Act, 2005 covers relationships “in the nature of marriage”, and courts have explained when a live-in relationship qualifies (D. Velusamy, 2010; Indra Sarma, 2013).
  • Presumption of marriage. In some cases, courts presume a marriage from long cohabitation, but the presumption can be rebutted.
  • Not equal to marriage. Rights to inheritance, maintenance, residence and recognition by authorities are narrower and less certain than for spouses.

There is no “conversion”

You cannot register a live-in relationship as a marriage. To become married, you must:

  • hold a valid ceremony under your personal law (for two Hindus, the customary rites, often including saptapadi) and register it; or
  • marry under the Special Marriage Act before the SDM, after a 30-day notice.

Choosing the route

Your situationRoute
Both Hindu, Sikh, Jain or BuddhistCeremony + Hindu Marriage Act registration
Same religion, other faithsCeremony + Delhi 2014 Order registration
Different religions or civil preferredSpecial Marriage Act

Documents

The documents are the same as for any couple: identity, age and address proof, affidavits, photographs and, for registration, proof of the ceremony. Your shared home can give jurisdiction if your Aadhaar or a registered rent agreement shows that address. See documents required.

Children born before the marriage

If you have children born before marriage, marrying and registering helps simplify their documents. Courts have protected the rights of children of long live-in relationships to inherit their parents’ property. After marrying, check that both parents’ names appear correctly on the children’s birth certificates.

Live-in registration elsewhere

Uttarakhand’s Uniform Civil Code requires registration of live-in relationships in that state. Delhi has no such requirement. If you lived together in Uttarakhand, take advice on any obligations there.

When one partner is already married

If either partner is still married to someone else, the relationship generally does not qualify as one “in the nature of marriage”, and a new marriage is not possible until the earlier marriage ends by divorce. See can you remarry while your divorce is pending?.

What to do after you marry

  • Update joint records: add each other as spouses on bank accounts, insurance and investments.
  • Update the lease or property papers, showing your marital status where relevant.
  • Children’s documents: check birth certificates and school records name both parents correctly.
  • Wills: make or update wills; marriage changes who inherits.
  • Passports: add your spouse’s name if you plan to travel or move.

Timeline for a live-in couple

Week 1Decide the route; gather documents at your shared address
Week 1–2Ceremony (or Special Marriage Act notice)
Week 2–3Registration appointment, or day 31+ for a court marriage
AfterwardsUpdate records and nominations

Can we keep our ceremony small and private?

Yes. A Hindu ceremony needs only the customary rites and witnesses; it can be at a temple with a few friends. A Special Marriage Act marriage needs three witnesses before the SDM, and its notice is displayed publicly for 30 days. If privacy is important, consider which route suits you. See court marriage notice privacy.

Common mistakes

  1. Assuming years of cohabitation equal marriage.
  2. Signing a “marriage agreement” or notarised affidavit instead of marrying.
  3. Not updating nominations and documents after marrying.
  4. Delaying marriage until a crisis, such as illness or a visa deadline.

Worked example: after five years together

Neha and Arjun have lived together in Gurugram for five years and want to buy a flat in Delhi. They marry at a temple in South Delhi, where Arjun’s parents live, and register under the Hindu Marriage Act, then add each other as nominees and co-owners.

Worked example: planning a child

Sara and Dev, an inter-faith couple living together in Delhi, decide to marry before starting a family. They give notice under the Special Marriage Act and marry after 30 days, so their child’s documents will be straightforward.

If your families do not know

Some live-in couples have not told their families about the relationship. Marrying does not require family involvement: adults do not need consent, and witnesses can be friends. If you expect opposition, plan for privacy and safety. See registering your marriage without family support.

Worked example: moving abroad together

Raghav has a job offer in Dublin, and his partner of three years, Ishita, wants to join him. Ireland’s dependent route requires evidence of the relationship, and a marriage certificate makes this simpler. They marry in a temple ceremony in East Delhi, register under Tatkal, and apostille the certificate before they leave.

Key terms explained

  • Live-in relationship: an unmarried couple living together.
  • Relationship in the nature of marriage: a live-in relationship with features similar to marriage, protected under the domestic violence law.
  • Presumption of marriage: a court’s assumption of marriage from long cohabitation, which can be rebutted.
  • Uniform Civil Code (Uttarakhand): the state law that, among other things, requires live-in registration there.

One-line takeaway

A live-in relationship is legal but not a marriage; to get a spouse’s rights, marry by a valid ceremony or under the Special Marriage Act, and register.

Frequently asked questions

Are live-in relationships legal in India?

Yes. Courts have held that adults living together by consent do not commit an offence.

Does living together for years make us married?

No. Courts may presume marriage from long cohabitation in some cases, but that presumption can be rebutted and is no substitute for a valid marriage.

What rights do live-in partners have?

Some protections, such as under the domestic violence law for relationships 'in the nature of marriage', and maintenance in certain cases. They are narrower than a spouse's rights.

How do we turn our live-in relationship into a marriage?

Marry in a valid ceremony and register, or marry under the Special Marriage Act.

Do we need to register our live-in relationship in Delhi?

No. Delhi has no live-in registration law. Uttarakhand's Uniform Civil Code requires registration of live-in relationships there.

Can we use our shared rental address for marriage registration?

Yes. A registered rent agreement or Aadhaar at that address can establish jurisdiction.

Are children born before the marriage legitimate?

Courts have protected children of long live-in relationships in matters such as inheritance of parents' property. Marrying and updating records strengthens their position.

Can a married person be in a valid live-in relationship?

A relationship where one partner is already married generally does not get the protections given to relationships in the nature of marriage, and a later marriage would require divorce first.

Is the process different for live-in couples?

No. The documents and steps are the same as for any couple.

Should we have a big ceremony?

Not necessary. A simple valid ceremony or a court marriage is enough.

Does marriage affect our existing joint lease?

No, the lease continues. You may wish to update it to show you are married.

Can a notarised 'marriage agreement' replace marriage?

No. A private agreement does not create a marriage.

Can we marry at the SDM office the same week?

Only by registering a ceremony you have already held. A Special Marriage Act marriage needs at least 30 days after notice.

Do we both need to be 21?

The man must be at least 21 and the woman at least 18.

Can our long relationship evidence help a visa application after marriage?

Yes. Evidence of living together supports the genuineness of the relationship alongside the marriage certificate.

Will the SDM ask how long we have lived together?

Not usually. The officer is concerned with the legal conditions and proof of the ceremony, not your history.
